Duke Lacrosse Player May Face D.C. Assault Trial

WASHINGTON - One of the Duke lacrosse players arrested for rape in North Carolina could end up being prosecuted in the District for assault, WTOP has learned.

Under a D.C. first-time offender agreement, Collin Finnerty, 20, of Garden City, N.Y., agreed to do 25 hours of community service after he was charged with a Nov. 5, 2005 misdemeanor assault. The deal called for the charges against him to be dismissed after he completed the community service and provided he stayed out of trouble.

In light of the rape charges, the U.S. Attorney's office is considering filing a motion to revoke Finnerty's community service agreement.

In the D.C. case, Finnerty and two other men allegedly assaulted a man outside the Daily Grill on Wisconsin Avenue. According to court records, the victim said he was minding his business when the three started picking on him, calling him gay.

In the North Carolina case, a 27-year-old black woman who is an exotic dancer told police she was attacked March 13 by three white men in a bathroom at a party held by the lacrosse team.
